2010 Oct 12 – SSSF HOA Annual Meeting

Silver Springs has 189 lots, forty-five members (some were spouses) attended the Silver Springs Annual Meeting and Election. The top three vote counts were for Tracey Douthett, Ed Cody, and Jim Harsch. We look forward to working with these new board members. The returning board trustees are Kristian Mulholland, Harry Fuller, Richard Krebs, Brian Robinson.
The ballot count was very close, only one vote difference between each of the nominees. So you see your one vote could have made a difference.
At the beginning of tonight’s meeting the board held a quick trustee meeting with five members present (Krebs and Fuller were absent).
The board made a motion to change the SSSFHOA Bylaws to read: “All nominees to the Board of Trustees must be members in good standing.”
This appears to be another ploy to eliminate the property owners who are firm in their belief that the Bylaws and CCRs are to be upheld. These owners have chosen to not pay the $182 special capital improvement assessment for the private small lake until the board allows the property owners to vote, as is written and provided in our HOA charter.
Bylaws Article XI Amendments states “These Bylaws may be amended, at a regular or special meeting of the Board of Trustees by majority vote.” The amendment process of the Bylaws has always been through notification and by vote of the property owners as a whole. This board chose to take a vote of the five trustees present only.
We intend to do further investigation on the validity of the board’s amendment action tonight to change the Bylaws without participation by the property owners.
The board wants the property owners to adhere to the HOA rules, yet again they are manipulating the rules for what appears to be personal motives, this time after the nominees had been submitted and most of the Members had cast their ballots (ballots that did not include the names of all of the nominees). Changing the voting process at nearly the end of an election does not appear ethical.
When discussion on the efficacy of this action was questioned Bill Gunter told the participants, “Oh, just be quiet.” Then proceeded with the next item on the night’s agenda.
We are really looking forward to a fresh start with a new board.
We will post the Minutes of tonight’s meeting as soon as we have them typed.
Best regards,
Lucy Archer
